These terms and conditions apply to purchases in the online store bohemialighting.com. The terms and conditions specify the rights and obligations of the seller and the buyer.

Buyer:

The buyer is everybody who makes and sends the complete order in the onlinestore www.bohemialighting.com.  The customer confirms that agree with trade conditions. Each buyer/customer is obliged to read trade conditions before he will make an order. By doing so, the customer also confirms that he has read these terms and conditions and undertakes to comply with them.

2. Price and payment conditions

All prices presented on this webpage are including VAT tax.

The acceptable payment methods for ordered goods are:

a) bank transfer, for CZK bank account 2503107036/2010 or

                                  for EUR bank account 2003107048/2010

b) credit cards Visa, MasterCard

c) cash on delivery - is possible only in the Czech Republic

After receiving the order, we will send the Customer the final price of the order together with our bank account number and the order number. The variable symbol for making the payment is the order number. Payment of the purchase price is a condition for the handover of the purchased item to the customer and the transfer of ownership of the purchased item to the Customer.

The shipping price is stated as a separate item for the goods. The shipping price is based on the weight of the shipment and the selected country of shipment (destination).

 

3. Order

The purchase contract, on the basis of which the sale of goods is made by the Seller to the Customer, is created on the basis of a binding order confirmation. A confirmation is considered binding after the previous sending of the electronic order in the case of payment by card.

A binding order confirmation in the case of payment by bank transfer (or sending an advance invoice) is considered to be the sending of the advance invoice and the subsequent proof of the payment about receiving amount to the seller's account.

 

4. Production and delivery times

The majority of Bohemia Lighting chandelier orders are completed within 30 days from the date of payment. We consider the day of payment of the order to be the date of crediting the payment to our company account.

Some models of lightings especially from the „Modern and design collection“, hand painted by high quality enamel or with hand cut glass parts, and custom-made lightings or otherwise modified lighting fixtures will have a longer production time of approx. 3-8 weeks from the date of payment for the order.

For each product in the e-shop, an approximate delivery time is indicated. In the event of a change of the delivery time, we will inform you immediately by e-mail. We will inform you about dispatch day including the tracking number of the parcel, one day in advance. We will be happy to inform you of the current availability of specific luminaires upon request.



5. Import Customs Duty and VAT - Buyers Outside the EU

All international orders to outside European Union countries are subject to taxes due to the destination country. Bohemia Lighting e-shop is not responsible for any customs fees or taxes incurred on international shipments as these are the responsibility of the Customer. Customers outside the EU pay the Bohemia Lighting e-shop only the price of the goods + shipping costs (both excluding VAT).  Import duties and taxes are the responsibility of the Customers in accordance with the tax laws of their country. The rules and procedures in non-EU countries are different, please check with your local customs office for the rules and regulations regarding the import of goods from European Union countries.

 

6. Product quarantee

Lightings purchased by Bohemia Lighting are top quality hand made products which should serve you, with a careful maintenance, for many years. They are intended to illuminate standard dry interiors.

The manufacturer guarantees that the product's quality specified by corresponding norms will stay the same 24 months from the date of sale and in the case of sales to corporate customers for a period of 12 months from the date of sale. Our lightings are supplied semi-assembled with a clear assembly instruction including drawings.  All lightings are delivered without light bulbs.

The Customer is obliged to immediately inspect the lightings delivered by the Seller and to inform the Seller of any defects found within 3 days. The Customer must notify the Seller of any defects in writing (by e-mail) within 3 days of receipt of the goods. In the written notification, the Customer must state what the defects are and how they manifest themselves. The Customer sends a written notification of any defects to the Seller's e-mail address info@bohemialighting.com.

The complaint must be submitted together with invoices copy, proof of payment and delivery, and with correct filled-in guarantee certificate of the product which defects are claimed.

The seller is not responsible for damage resulting from the standard use of the goods, functional properties and damages from improper use of the goods, as well as damages caused by external events and incorrect handling. Defects of this origin are not covered by the warranty provided. The Seller undertakes to inform the Customer no later than 5 working days from the date of receipt of the complaint about the procedure and method of settlement.

 

7. Damage during transport

Our lightings are shipped by several carriers chosen with regard to the reliability, quality and price of their services.

Always check the consigment in front of the courier. If the shipment is damaged (the packaging is torn, wet, etc.), the Customer must write a complaint protocol with the carrier. This is a necessary condition for us to be able to recognize a claim for damage during delivery by the carrier. The complaint must be submitted in writing within 3 days of receiving the shipment from the carrier. Once the Seller receives the complaint, will contact the Customer to discuss further steps.

 

8. Money-back guarantee

The Customer has the right to have the goods exchanged or to receive a refund. If you are a consumer, you have the right to return the purchased goods without giving a reason within 14 calendar days from the date of receipt of the goods, in accordance with Section 53 (7) of the Civil Code and Directive 97/7/EC of the European Parliament and of the Council on the protection of consumers in respect of distance contracts.

It´s necessary to restore the returned lighting to its original condition, which will prevent a possible reduction in the refunded amount by the costs incurred in restoring the goods to their original condition. The returned goods will have a commercial invoice copy and filled-in withdrawal form confirming the legitimacy of the request to return the purchased goods within 14 days without giving a reason. The costs of returning the goods to the Seller will be paid by the Customer. The Bohemia Lighting e-shop reserves the right not to accept returned shipments sent on delivery or goods that are missing the original packaging, quarantee certificate or goods that are damaged in any way.

After the Seller receives the shipment, the shipment will be checked and the Seller will contact the Customer about further steps.

The money for the returned goods will be send to the Customers bank account as soon as possible, not later than 14 days from delivery of consigment to the Bohemia Lighting address.

If you are not a consumer and you purchase goods as part of your business or commercial activity (which you decide by stating your ID or VAT tax number on the invoice), you do not have the right to return the purchased goods within 14 days without giving a reason, as the Commercial Code does not provide for this option.

The right to return goods does not arise if the goods have been modified according to your requirements (custom-made) or if you are a consumer living outside the EU.


9. Duration of the obligation

Obligations from contracts concluded on the basis of these terms and conditions are concluded for an indefinite period of time and the conditions for their termination are governed by these terms and conditions, the purchase contract and generally binding legal regulations.

 

These Business Terms and Conditions become effective on the 1st of February 2025.
